CONSTABLE
DEFINITION OF A CONSTABLE
A Pennsylvania Constable is a person elected to the public office of Constable and is a sworn peace officer. Constables by virtue of their office, are also Public Officials, Law Enforcement Officers, AND Police Officers. Constables are the oldest Law Enforcement in the Commonwealth of Pennsylvania.
POWERS OF A CONSTABLE
Pennsylvania Constables have statewide authority that is vast. We can arrest by warrant and can conduct warrantless arrests for felonies and breaches of the peace, including warrantless arrests for felony violations of the drug laws (see Commonwealth v. Taylor, 450 Pa. Super.
We can direct traffic, perform evictions, enforce any court order, and even stop motorists from endangering the public which is a breach of the peace.
Constables initially were the ONLY form of Law Enforcement in Pennsylvania and the Country, and none of our powers have ever been stripped or revoked.
